Recently, the Zhejiang Provincial Higher People's court formally heard the appeal case of trademark disputes between Ningbo music Kark Clothing Co., Ltd. (hereinafter referred to as "Le Kark") and Xiamen Jinji company, Shanghai Golden Rooster company and mojk company.

In the end, Le Kark won the lawsuit again, and was awarded 80 thousand yuan in economic losses.


The case began in 2008 and was infringed on the registered trademark of "rooster" pattern with the right to use it. Kark, a business mark holder of Japan, authorized the Xiamen Jinji sporting goods Co., Ltd., Shanghai Jinji sporting goods Co., Ltd. and Jinjiang mojk shoes and Garment Co., Ltd. to court.

The intermediate people's Court of Wenzhou, Zhejiang province decided that the three defendants violated the exclusive right of the registered trademark of Kark company and compensated the plaintiff's economic loss of 80 thousand yuan.

After the first trial, three defendants refused to accept the case and filed an appeal.

The higher people's Court of Zhejiang finally made the final judgment of upheld the original judgment of the first instance.

Infringement not only infringes on the rights and interests of consumers, but also seriously weakens the power and capability of independent innovation, which will eventually lead to the loss of core competitiveness.
